New application during cutrailment period

Hi all,

I am dealing with a situation whereby one of my clients Sponsorship Licence expired without their knowledge and subsequently the Tier 2 ICT visa of the sponsored employee was curtailed. Their Tier 2 ICT was issued in 2014, and was extended in 2017. The main holder also has Dependants with him in the UK whose visas were also issued in 2014 and renewed in 2017.

The client is now applying for a new Licence and hopefully this will be in place before the curtailment period ends (beginning of July 2018).

Will the employee be able to apply for another extension to the Tier 2 ICT once a new licence is in place from the UK; or would they need to leave the UK and apply for a new T2 ICT from abroad (likely high earner so exempt from cooling off period).
