Last week my solicitor received my supporting documents, passport and decision letter stating I should received my BRP within 10 days. I noticed that the HO put my old address on the letter and pointed it out to the solicitor. I don’t think he was paying attention and he said it shouldn’t be a problem. Today I received another email from my solicitor asking if I had received my BRP. I told him I hadn’t, and I thought he would receive it as he was representing me and revived all of the other documents. He told me that he didn’t know where it was and it could be sent to me OR him. I reminded him that the wrong address was on the letters that he received and I thought my BRP could be sent to the wrong flat. I told him I would go to my old flat to check.
This evening I went to my old flat and luckily the lady who now lived there answered. I gave her my information and asked her to keep an eye out for my BRP as I think it would be sent to her address. 30 minutes later she called me as she asked her boyfriend about receiving any letters with my name on it and she had — it was in the rubbish. She dug through the rubbish for me and when I walked back over to her flat I received a greasy envelop with my BRP inside. Her boyfriend threw it away as it wasn’t addressed to either of them.
I was lucky!
My question is: Can I claim compensation? And how much can I claim?
There is no reason the HO should have made this mistake as I clearly said in the application (along with all of my years of paperwork I submitted) that I do not live at that address anymore.
Old address: 2013-2014
New address: 2014-Present
Any advice would be greatly appreciated.
