FlR(DL) to ILR (not received biometric letter)

hello,
my mother applied for ILR for herself and me (dependent) and i am 21. we have had DLR for 6 years so far
she applied towards the end of february, but up till now she has not received any correspondence ie biometric letter or acknowledgment letter, even though they have taken payment.
from looking at similar timelines we should have received one within 6 weeks but its been more like 11 weeks so far

anyone experience a similar delay and have any advice on what we can do..

I have same problem as you I applied for ILR after (3*2) 6 years of discretionary leave after faild asylum seeker first DL granted (9/ January 2012) second DL (9/June 2015) via postal application ( FLR DL) I still not received any correspondence from home office even they took the fee of £2389 but not heard anything from them I called few times they told me ones you have to wait 2 to 4 weeks for biometric to be received and I called them today they told me I have to wait 4 to 8 weeks for biometric every time I got different answer . seems they don't know what they doing . I just need proof of right to work in UK to show to my employer or I'm going to loose my job . Here is my time line :

Pstal FLR DL form : 8/May/2018
Received by home office: 9/May/2018
Payment taking from my account: 10/May/2018.

Till now I'm still waiting for everything else and I'm going to loose my job if I don't show my employer any proof by 9 of June 2018 that's the expiry date on second three years DL .
That's not fair at all .
Any one can advise some help will be appreciated thank you.

You have applied by post on 8th May, Today is 31st May, there is no way you will get your BRP when you haven't even been sent the Biometric Enrollment letter. I applied on 12th Dec 18, got the Bio enrollment letter on 16 Jan 18, never got any acknowledgment letter until I got my ILR BRP on 16 May.

I suggest you humbly ask your employer to carry out the Employer's Checking Service

A google search should give you the link.

They should hopefully be aware of this service and be willing to do it for you. As long as you applied for ILR before the expiry of your second 3 year DLR, your right to work will carry on until a decision by UKVI.

I think you need to be mentally prepared to wait a few more months, hopefully your employer carries out your check. I don't think you will necessarily lose your job, the employer may not even realise (like in my case) that your DLR is expirying. My employer never checked so now I have ILR, the day they realise that they employed me on DLR (limited leave) and start asking questions, I'd happily show them my ILR BRP!

Thank you for your quick reply I will take your advice and I tell my employer to do that check .
I will update any news from home office .
I really hope this waiting will and soon because I been in this country for 12 years just I want to relax and clear my mind from visa game and get on with my life as human being time is running we get in older and we still just trying to sort a piece of paper to decide our life it's really hard and stressful I know there's a lot of people like me . But from my experience always *hearing human rights human rights* there's no human rights just big lies.

He said to me if not heard from home office by 9 of May I will be suspended from work til i have some form of proof to show right to work .
I hope I hear something by this week inchallah.

i applied in february as dependent on mothers application, home office said i should apply on seperate form within 10 days in early may as i am over 18..
so its like fresh application but not overstayer, sent application and they received everything fine and now just waiting for biometric letter like you..
praying to God it comes soon, feel like my life is on the line

By the way my employer just gived me today suspending Letter from my job .and told me I be back to work when I provide home office reference number so he can do the check for right to work . Just I'm so frustrated and loosing sleep over this situation.

You should have informed employer that under the Immigration Rules section 3C/3D, if an intime application is made, your working rights & valid leave to remain are retained and continous even after expiry of your last leave to remain until a decision is made on your pending application.

Hello CMOSUK and thank you for your advice

Today 7 of May 2018 I received knowledgment letter along with biometric enrollment and I enrolled straight away today in my local post office .

In the knowledgment letter clearly stating that all the conditions stay the same that's mean I'm allowed to carry-on working as I applied in time month before expiry date on my leave to remain by the way I took the letters I received to my work place for my Aria manger to see them but his not was there I left him photocopies , I hope I hear from him tomorrow .

birth certificates and marriage certificate with the acknowledgement letter.

i am very happy for you that you have received your biometric letter, and i think it just means they can take an indefinite amount of time to consider the application, but dont worry too much.. there should be no reason for us to not have indefinite leave to remain by the Grace of God
