Waiting to meet requirements for Defacto

Post by Zoomcool » Mon May 14, 2018 5:46 pm

My Girlfiriend (non EU national) and I (Irish National) are living together just over a year now she is currently on a Stamp 2 Visa which will expire on August.

In order to make up the additional time so we can apply for a de facto visa can she apply for a stamp 3 visa? I know she wont be able to work on this Visa but I am able to full support her until we get the de facto Visa application process complete.

Any advice would be greatly appreciated.

dont take this granted as im not sure about this, but

http://www.inis.gov.ie/en/inis/pages/re ... mps#stamp3

"Examples when used
You may be given Stamp 3 if you have permission to:

Volunteer, eg with a charity or non-profit
Be a minister of religion
Join your non-EEA/EU/Swiss spouse/civil partner or family member who is here based on a work permit
Other"

i think spouse of Irish can have it, but a student on a stamp2 , who is a "only" a girlfriend - no offence - not sure why would they change her stamp. Stamp2 is not reckonable as residence but stamp 3 is, big difference.
If she could be here for 1 more year on stamp 2, and u could get all ur proof of addresses together to prove that u were living under the same roof for 2 years (electricity, gas, bin collection, fixed line internet, etc.. ) it would be a good start, cause as a defacto partner u have to prove that.

also she has to leave the country before applying for visa D defacto relationship, unless she would give birth to ur children, than u could use the Zambrano case and she could get stamp 4 without leaving.
