Switching From FLR FP TO FM with Condition

Hello Guys,

This is my first post for over 12 years i have been reading.During my days in college and university and naturalisation i have used this platform and i thank the moderators for a job well done.

My Story..

My partner Did Proxy marriage with a french guy in Ghana ( Both were not present ) and she did apply for spouse visa which she was rejected even went for Judicial review still was rejected.. Home office did not believe that the relationship was real hence the refusal.

Fast forward.. I met her in 2014, we started dating and in 2016 and 2017 we had our kids ( a boy and a girl both British). When we had our first child together in 2016, she did apply for FLR FP parent route based on our daughter and she was granted 2.5 Years.

Now, we want to legalise our relationship and we went to the local registry where we live in south east, HO has approved it though on our form WE DID SAY SHE WAS NEVER MARRIED.. However, I have forced her to do a divorce ( just to be on the safe side ) which the degree absolute just came back after six months..

My Questions below
1. Since HO did not recognise the union then, in her application ( fm) will she state she was once married or ignore ?
2. When we went to the local council, we said none has been married and home office gave approval, will that hinder her application ?
3. should be just say she is divorce and add the degree absolute in the application?
4. I meet all the financial requirement as i earn more than 50k but i am worried that they might refuse her for telling lies that she was not married when she did ...

Please i need advise... Thanks

It appears from your post that the Home Office didn't question the legality of the proxy marriage, but they believed that the relationship wasn't genuine.
In this case your partner should have declared the marriage. In my opinion you should first rectify this with the Registrar to avoid the consequences of having given false information in your marriage registration, which could be considered as perjury. :idea:

My problem now is that we have fixed a date for the registry in July 24th..

Should will go back to the council and tell them the truth or we reapply for new marriage approval?
