HM Armed Forces eligible for ILR

Post by MMitchell18 » Fri May 18, 2018 6:52 am

Hello,

I’m struggling to understand what category I was placed under for my spousal visa. I was granted initial entry back in October 2013 for 27 months, and then was issued FLR in January 2016, for 30 months. I’m now approaching the expiration of my leave in July 2018, but may not be eligible to apply for ILR as I’ve not been in the UK for a total of 60 months. My husband is in the Armed Forces, so apparently we may have been classed under a special category during our first application in 2013, but we aren’t sure. My visa stamp and BRP don’t state anything about Armed Forces. From what I understand, until November 2013, Armed Forces dependants were allowed a two year stay; however, I’ve been told by an immigration advisor that we were classed under one set of old rules for the first visa and then classed under a second set of new rules for the FLR, which means the two time periods haven’t married up. Therefore, nobody is sure whether I’m eligible to apply for ILR as I’m three months short of the 5 year probationary period under the current rules. Anybody in a similar situation or able to shed some light on this? Any help would be greatly appreciated!
