Child born overseas after naturalization, but before ceremon

Post by mixaxo77 » Fri Feb 10, 2017 6:50 pm

I need an advice regarding immigration status of my daughter M.

I arrived in the UK from non-EU country with work permit in October 1998.
After have lived 5 years applied for the British Citizenship in the beginning of 2004.
I have applied via one of the professional immigration consultancy companies. I consider this a mistake as my case was very straightforward. After have applied for the Citizenship, I have moved house and let the company know my new address.

My citizenship has been approved on 20-th October 2004. The company by mistake sent the copy of Ceremony invitation letter to my previous address, where my ex flatmates returned it back only after 7-8 weeks. As a result on 13-th of December I received a phone call from the company acknowledging the return of the invitation letter. After that I received the copy on 15-th of December and was booked for the Ceremony on 27-th January 2005.

My daughter M was born overseas on 16-th of December. If not the mistake of the above company I should have passed the Ceremony by this date and M. would have been British by descent.

The documents I have:

1. The Citizenship Ceremony Invitation letter dating 20 October 2004
2. The letter from the company informing reception of this letter and confirming that it was their mistake to send the copy to wrong, previous address. This letter is dated 14 December 2004.
3. The letter from County Council inviting me to the Ceremony on 27-th January 2005, dated 15 December 2004.

It's obvious that if not the negligence from the company M. should have received British Citizenship by descent as my second daughter has.

Do you think I may be successful if I write to Home Office and ask to consider granting M
British Citizenship by descent.

Many thanks.
