Hello

I am in need of some advice. I currently hold a ILR in the UK. I am due to travel to Portugal for a family vacation, after some back and forth with the consulate in Manchester I have been told it's too late for me to submit my application as it is the end of this month. My question is am I eligible to travel under my father's name as he is a British national and so is my daughter and both are meant to travel on the same trip? I hold a Zimbabwean passport with the ILR. Please any advice

Short: No, you can not travel using your father's passport. It doesn't constitute an entry visa.

You have EU family members.
That gives you the right to move freely within the EU with them.

However if you are a visa national, then you must have a visa to enter the other EU country.

There are two ways to get a visa:
- At a consulate (they legally have 15 days to process your application)
- At the border (for whatever reason if you arrive without a visa, they must issue it then and there)

Without a visa, however, you won't be allowed to board the plane.

So to make it to the border you must travel by car, ferry, train or something.
Basically somehow make it to the Schengen border and they would have to issue you a Schengen visa then.

You still need to prove that:
A) you have EU Family members
B) Travelling with them OR travelling to meet them.

If they tell you no, show them the webpage below and quote the EU directive 2004/38/EC.

Arriving at the border without an entry visa

It is always best for your non-EU family members to be well informed in advance and have all the necessary documents before starting their journey.

However, if they arrive at the border without an entry visa, the border authorities should give them the opportunity to prove by other means that they are your family members. If they manage to prove it, they should be issued with an entry visa on the spot.

Thank you for the replies. I have managed to contact the airline I am flying with to ask if it is possible to board from the UK and get a visa on arrival and I have been advised that it is possible only if i bring along my birth certificate and a valid passport. I have requested to have this in writing so I will not have any problems when boarding on the day of travel and they have sent me an email that specifies all this.

A big thank you, I would have missed out on a family holiday if i hadn't read the articles here.

Woah that is huge news! Congratulations.

From everything I read here I have never ever seen it happen (let the board the plane without a visa).

Can I ask what airline is this and how did you convince them?
And do you know why is it that they ask for a birth certificate?
