ILR Refused. HO reconsidering

ILR Refused. HO reconsidering

Hi All,

I applied for ILR via 5 year route tier 1 general category in feb 2016. It was refused under section 322(5) due a tax amendment in year 2010-11. HO later removed 322(5) from my refusal in an admin review, they admitted it was inappropriate to apply section 322(5) in my case but they still maintained thier decision to refuse my application under that category.

In sep 2016 I became eligible and applied under 10 year route. In feb 2018 they refused this application too and applied 322(5) again refering to the same tax amendment.

My solicitor suggested making a complaint to HO as the caseworker did not take into consideration the fact that HO had already accepeted in the previous AR that it was inappropriate to apply 322(5) in my case.

After my solicitor lodged a complaint HO wrote us a letter to say they are going to reconisder the application.

We have already appealed the decision @FTT . Hearing is scheduled in September.

My questions are:
What are the chances of HO granting the leave before the hearing?
How long do they take to reconisder?
The deadline date for HO to send the appeal bundle to us has elapsed yet they still haven't sent the documents. Does this mean anything?

I honestly appreciate any bit of advice you guys can give.
