Can anyone please clarify the following HO guidance for me:
“Date of application: application to vary
Where an application is varied, the application date remains the date of the original application....
However, for PBS applications, where a variation application is made in accordance with paragraph 34E, then, for the purposes of assessment against the rules, the date on which the variation is made should be treated as the date of the application.”
I’m inside UK. I want to make a Tier 4 application for extension in 1/2 days and vary it to a Tier 2 application after 3/4 weeks. Which date will be considered as the date for my application - original application date or variation application date? I’m not sure if paragraph 34E applies to my application. Thanks!
