Hi Gurus,

Hope all are enjoying spring season 💐

I had lost my first 3 years due to new rule of absence.

I shall be applying for Extension in Jan 2018

It seems it would take around 6-8 months for receiving extension

I want to opt for 3 Years Accelerated Route after Extension

The question arises that if I apply for Extension in Jan 2018 what would be start date of my Approved Extension ? Either my extension date would be starting just after the date of expiry of my current stay/visa or there would be a new Date from where I would have to count next 2 years for my Extension? Those who had already received extensions may please help me out getting out of this confusion

Since the Extension is Granted for 2 Years so how I would be able to claim of my 10 employees towards 3 years Accelerated Route ? Wouldn’t these 10 jobs vanished alongwith expiry of my granted period of my extension ??? This has become a chess challenge to please solve for me with your advise and expert experiences

Actually I have a proper running business with everything in place except my presence which I shall be ensuring from hereafter for next Continues 3 years to get Qualified for Accelrated Route BUT the 2 Years Extension and the Expiry of 10 Jobs with the End of Extension Period is really Confusing as How this could be managed

Please help me help all

Your new period will be two years from the date the extension is granted i.e. extension start date is the date of extension approval.

Don't understand this.
The three years is always calculated back from the date of your ILR application. So, depending on when you qualify for the three year continuous period, if you had 10 jobs in the 12 months prior to your ILR application date, you would be able to apply for accelerated ILR.

Three Years backwards from the date of application of ILR is clear to me now THANKS

My second query is actually quite confusing that’s why I am seeking help from the expert gurus

Say for example my extension is granted in Jun 2019 untill Jun 2021 for 2 years

So in these 2 years if I appoint 10 employees how can I claim them towards Accelrated Route ILR because 3 years can’t be completed in 2 years extension time ? And as far as my understanding is concerned I believe the Jobs would be only counted form the date of extension is granted so it’s useless to appoint eployees prior to receiving the extension approval date in this case how would I be able to manage to show 3 years ???

Do I have to apply for another extension to achieve my mission please advise

There are two different criteria for the accelerated ILR
1) Three years of continuous residence
2) 10 jobs of 12 months each

The two are separate and not connected to each other.

So, if you get your extension in Jun 2019 and your have three years of continuous residence between July 2016 and Jun 2019, then you can apply in July 2019 if you have 10 jobs of 12 months each between August 2018 and July 2019 (12 months before your ILR application).

As per the revised rules this year, this has changed slightly.

If you are applying for ILR within 12 months of your extension grant, you can use the job creation in 12 months before your ILR application date - even if some of that period is before the extension. (Hence the example above)
