Tier 2 Dependent visa

I am a Tier2 General since 0ctober 2016. Got married on 5th April 2018 and my husband applied on 6th June for dependent visa. I have done this through a solicitor and unfortunately she did not advised us to send a TB test screening. I have only found out now through forums.

My question: will the application be rejected ?

How can we send the document ?

If they reject the application, are we gonna pay the visa fees for the 2nd time?

Please please help me!

It is a mandatory requirement. Generally any misses Entry Clearance Officer will perhaps request applicant to supply. We hope he does it instead of rejecting it as these application is costly to do it second time.
Why don't you contact the UKVI contact centre and explain the situation. And meantime get the TB screening done as results will be available in a day

Thank you very much for your reply.
I have called the home office help line. They guy explained that this is mondatory (I should not have relied on her :( ) This costs a lot really... he wrote an email to the visa officer and we wait for their reply. However, it can take up to 15 working days to get a response. Shall we wait or just withdraw and reapply ?

Not sure whether u can withdraw. If helpline team already passed information to ECO, then perhaps you will get an email requesting TB certificate. They say usually 15 working days but u may hear back well before that!!

I received 2 days a go a text message from solicitor informing that we have a bad news.. I knew it would be refused from first place.

I went to see her and surprised that my visa was refused based on Paragraph 319C d , e, f

"You have applied for entry clearance to join your partner in the UK. I note she is in possession of a UK Tier 2 (General) visa valid until 14 January 2019. I note you have submitted a marriage certificate showing you married on 15 April 2018. In addition to this, you have submitted some photos of you and your sponsor. You have also submitted 2 Facebook screenshots and a messenger screenshot however, these are dated from 2014 and 2015. You have not provided any other evidence of contact with your sponsor or any other evidence to demonstrate your claimed relationship.
I am therefore not satisfied that you have demonstrated that you are in a genuine and subsisting relationship with your sponsor. I therefore refuse your application under paragraph 319C(d), (e) and (f) of the Immigration Rules.
Given the above, I have refused your visa application on this occasion because I am not satisfied that you meet all of the requirements of paragraph 319C of the Immigration Rules."

I'm not happy that the solicitor did not advise us to put all calls and text messages.
Can I apply second time without solicitor ??? or do you think my case would be weak ?
Can I change the solicotor ?

You could apply with or without a legal advisor, but I strongly suggest that you change the solicitor whose negligence has resulted in a refusal. :!:

Be sure to submit ALL the required evidence this time. You should be able to receive all the guidance needed from members on the forum for free. :idea:

Thanks a lot @Casa. I am afraid that if we change a solicitor the ECO will be suspecious about us.
one more thing I'm worried about is the fact they did not mention the TB test missing document although it's a requirment. This means that in next application they can come up with new grounds of refusal ?!?

I'm so disappointed with her service and she wants to charge me more to make a new application
