Spouse visa - filing for divorce.

Post by Devin » Sun Jun 10, 2018 10:28 am

I am posting this query on behalf of a friend. She got married to a british citizen 2 years ago. She is currently on a spouse visa ( I think its FLR M). Unfortunately her married life is not going well. I dont want to go in too much details but just want to say that things are so bad that she wants to file for a divorce. My question is waht would happen to her visa? If she gets divorce, would her visa get cancelled immediately or is there any sort of grace period given to sort things out.? Your help regarding this is highly appreciated.

If the relationship/marriage ends, then both the spouse and the UK citizen are obliged to notify the Home Office. They will usually reply by letting your friend know that they have 60 days to leave the country. If they don’t, they would become an illegal overstayer.

If they are currently working, then it may be possible for their employer to sponsor another visa for them. This application would be separate and would have its own approval/refusal.
