Non-EU Spouse Moving with EU kids to Germany Through UK

Post by kwanbis » Wed Jun 13, 2018 9:44 am

Hello All. I am a Spanish national living in Berlin since 1 month ago. My Non-EU wife (Colombian) is moving with us flying through UK to Berlin. I asked in the German embassy in Colombia and they say she doesn't needs a VISA, but I have found very confusing or contradicting information online, and I have written to the immigration office in Germany but nobody responded.

I believe that since she is married to a Spanish, and traveling with our kids who are also Spanish, she shouldn't have a problem getting into Germany, but I don't feel at ease and I was wondering if anybody know about this, or if there is something that I can do. By the way, I will be picking her up at the UK Airport, and she will be travelling to Berlin with me, but she won't have a visa (Colombians are not required visa to enter Germany for tourism, and a relocation visa takes 10 weeks).

My other concern is about the transit visa in UK. I cannot know for sure if she is going to need to pass border control, she will be arriving at Terminal 2, and leaving the same day at Terminal 5, so we want to get a VISA for her, but we worried how would UK authorities react to this.

Thank you.

She needs a visa to enter the UK.
This depends on type of her connection at Heathrow and whether she has to pick up her luggage and check in again. This would mean entering the UK.

She doesn't need a visa for Germany.
Colombians are visa free nationals.

If you need a UK visa you get it under EU directive.

Thanks. That is what I understand. You mean the UK visa for free?

Directive 2004/38 visas are issued free of charge.
Get a directive visa from the UK if you are changing terminals, airlines, etc. And need to pick up luggage and check in again.

Also remember to come back here and share your experiences with this visa project so it helps others in the future please.
