Please I need advice as my residency is expiring July. I am a non EEA national in a durable relationship with my EEA national since March 2011 and was given a 5 yrs residence permit 2013 on the bases of our relationship since then we have been living peacefully and planning to get married till 2016 when we started having problems but still together as we do settle our differences.On Dec 2017 we had a fight again and she hits me with a batten on my ribs which took me to hospital though i didn't reported her and I was later discharged that same night and I told her that if she pick up a fight with me again for no reason I will have no option than going to court to request for a non molestation order and she accept, but in may 2018 she picked up a fight with me again and I had to moved from the house temporary to another house own by the same landlord and she continue harassing and calling me all sort of names till I decided to take it to court on May 31 2018.
My question now is
1) The Judge adjourn the case as the bailant did not met her at home twice when he went with police to serve her the order.
2) The judge did not grant me the non molestation order as she has not been served
3) I tried contacting her but she refuses to tell me her location and her aware about rather telling me that when shes ready for her stuffs she will come for it.
Now my main question is can I retain my right of residence on the basis of domestic violence even though the case is still on as I need to put in application because my residency will runs out July 25 2018.
Please an advise will be helpful as I am really confused and I don't want to be Illegal when I have just less then 2 months to complete my 5yrs.
