ILR for PBS Dependant

Post by bangalore_1982 » Sun Jun 17, 2018 8:10 pm

Hi Experts

I have gone through a lot of information from this forum, but since my case was unique. I would like to take advice from the experts. I have contacted the solicitors but they seem to not give me any assurance

I got my ILR through Tier 2 ICT in 2014, My wife was on Dependant Visa till now. She entered the UK in 2013. She was away from May 2014 - Feb 2015 ( 265) days Leave, that is the only major Leave we have in the application. Every other leave is less than 30 days in a year.

I was told that as per the new rules from Jan 2018, the PBS dependants should also adhere to 180 policy.

Can you please confirm if she would be eligible for ILR, My solicitor thinks its not possible and he is asked me to extend the current visa and apply ILR after 2 years.

However, After reading certain posts here, I think i can apply for ILR for my wife. Please confirm and provide your suggestion

Thank You in Advance

As repeated many many times here the new rules ONLY AND ONLY apply to PBS dependants who got their visa AFTER jan 2018.
PBS dependants who got their visa before 11 Jan 2018 do NOT have any absence limit
