Refugee Divorce, UK

Post by alpha_111 » Wed Jun 20, 2018 9:25 am

I have a 5 year refugee residence permit here in the UK. My wife has the same but as a dependent on me. We applied at the same time here in the UK back in 2015 and we are 3 years through and therefore 2 years until we can apply for the ILR.

However, we are planning on getting a divorce. If we divorce now and she applies for an asylum on her own and receives a new 5 year refugee permit, will she need to spend another 5 years under her new permit to be able to apply for the ILR, or can she use the time spent under me as a dependent (3 years) towards the ILR?

Thanks
