Hi,

I am applying for the ILR based on long residency (10 years) as I have had tier 4 visa for 9 years and now I have tier 2 visa. I have 2 children who hold a BPS dependant visa that is valid until October 2020 based on my current Tier 2 visa. My children will finish 10 years next year (in Sep 2019) and I have sole responsibility for their upbringing.

what will happen to their current BPS dependent visa after I get my ILR based on long residency? Can they still use it until next year and apply for their ILR next Sep 2019? if it won't be valid after me getting the ILR, what kind of visa should I apply for them so they can stay legally and finish their 10 years in the UK?

If your children born here they can apply for their British citizenship after you get ILR.

If your children are not born here they will remain on the same dependent visa till 2020 and next year you can apply their apply ILR for them.

If they were not born in the UK, then, immediately after you are granted ILR, they may apply for SET(F).

I received two different answers. My children were not born in the UK. One said I still can use their current BPS visa and the other said I have to switch. Which one is correct? and, Is there a document from the UK Home office that explains this situation, please?
