Tier 2 visa extension

Hello,
I am about to extend my tier -2 visa.
Currently my experience salary requirement is £27000.00. as mentioned in Tier -2 guideline.
In my existing COS , i have 39 hours contact.
Can I issue new COS with 35 hours so that I can pro-rata salary to £24230.76 ? I guess this rules can only be used for those whose initial COS was issued before Nov 2016.
Please help as i need to issue COS ASAP !!

are you going to be having a change of contract? if you are working 39 hours then you need to be earning more. you shouldn't have different hours on your contract and COS.
If your new COS will quote 35 hours then you must be doing 35 hours and not 39.

Yes, employer has agreed to change my contract hours to 35 in both COS and in Contract.
Currently experienced salary requirement is £27000.00 . My employer is not willing to increase the salary at all. Can i pro rata this so that salary will only comes to be 35/39*39000= £24230.00 ?
