General help needed.

Post by JAMIEM » Sun Jul 01, 2018 10:55 pm

Hi folks. :) Would love some pointers and clarification in regards to what route to take and if you can spot any potential problems we could face. Our situation:

We began our relationship in London in December 2015. She is a Taiwanese citizen and her 'Tier 4 UK Student Visa' expired in October 2016 after graduating from university. She did some traveling around Europe (I visited her in Amsterdam, Rotterdam and Berlin during this time) and she then returned to Taiwan around Christmas 2016.

Since then I have visited her 6 times: 5 in Taiwan and another in Japan (during which I proposed!) in March 2017. She has visited the UK for work once during this time and has 2 more work trips to the UK set for 2 weeks time and in September this year.

Upon returning to Taiwan she has entered their 'Youth Mobility Scheme' visa lottery multiple times to try get back to the UK with no luck, same for finding jobs that provide a sponsorship visa.

I meet all updated financial requirements, own a property that is more than suitable for us and have a steady and secure job.

We're looking at getting married during her work trip to London in mid September 2018 using the 'Marriage Visitor Visa' and then her leaving her job in Taiwan and moving to the UK with me in December 2018 / January 2019 using the 'Spouse Visa' option...

Is this the best way we can go about this? I'm pretty confused by it all, but I think we seem to tick the relevant boxes.

Thanks so much for any help. I thought it best to ask here before heading to an immigration lawyer.

If she’s already scheduled to come to the UK on a visa for work purposes, she can’t marry here at the same time. Also there’s a process for getting married by giving notice, see here for more info https://www.gov.uk/marriages-civil-part ... n-national

The best route is marry in Taiwan and then to apply for a spouse visa for her to come and live in the UK.
My comments do not constitute immigration advice, if in doubt consult an immigration adviser/solicitor

Thanks so much for the reply.

She wont actually be here on a work visa (only attending a conference paid for by herself), so does that then make it ok?

Also does then negate your second point? If not, could you please explain further why you think getting married in Taiwan first is better?

Without the correct visa your partner will be unable to marry while in the UK.

Please don't send me PMs asking for immigration advice on posts that are on the open forum. If I haven't responded there, it's because I don't have the answer. I'm a moderator, not a legal professional.
