ILR DV want to bring child to UK

Post by maguai » Mon Jul 02, 2018 9:59 pm

HI everyone,

I would like to ask for anyone's help please, I would really appreciate it.

I recently have been given ILR due to domestic violence. I have children in the Philippines and I want to bring them here. I do not have any links to my ex-husband as I have a non-molestation order on him. I want to apply for our children using my ILR status. Could anyone please advise me as to how I can do this? What forms should I submit. The children are both under 18.

Yes, subject to sole responsibility or serious, compelling family or other considerations, adequate maintenance and accommodation, etc.

Thank you Vinny, I really appreciate it.

I just have one more question: Based on Family Migration , it says that :

If the migrant partner qualifies for indefinite leave to remain, they will be able to sponsor a child to settle in the UK after that without having to meet the financial requirement (income threshold). But they will have to demonstrate that (a) they now have ‘sole responsibility’ for a child who has lived apart from them overseas for a long period; and (b) they will be able to maintain and accommodate the child adequately without recourse to public funds.
Does this mean I do not have to meet the financial requirements then?

Thank you.

My apologies, I forgot to ask about Sole Responsibility. based on what I have read:

the applicant’s parent has had and continues to have sole responsibility for the child’s upbringing -

How does one prove this? The documentation I can think of are:

Remittances - money sent to the kids
Facetime Screenshots
Photographs since they were born until they are grown
My Medical Cover in the Philippines listing them as my dependents
Their Birth Certificates - since we were not married when they were born - is the same as my maiden name

Do you think these documents would suffice?

Thank you
