I am in need of advice and support regarding Family Permits and EEA(EFM) visas.
To give you a quick run down on my situation...
I am from New Zealand currently living and working in the UK on a Tier 5 Youth Mobility Visa which expires in Sept 2018.
My partner is an EU national and I believe we have sufficient proof of relationship of 2 years+.
I am looking to stay and work in the UK for a further 6 months after my visa expires (until around March next year).
I have investigated the EEA(EFM) visa option however there are 2 main complications with going down this path...
a) I would not be able to travel between EU and UK while waiting for approval due to having to give back my BRP.
b) I would not have Right to Work for potentially 3 months+ while waiting for the EFM visa to be approved.. this is not really feasible.
I have also come across the 'Family Permit'.
I understand the intention of this permit is to allow people outside the UK to join family members within the UK and then apply for the appropriate Visa.
However it seems to essentially fit what I require in that it:
- Is valid for 6 months
- Gives unrestricted Right to Work
If there is a possibility for me to be approved for a Family Permit it seems to be by far the best option.
My question is this...
If I was to leave the U.K. when my Tier 5 Visa expires and then apply for a Family Permit (from Germany for example) is there any reason why a Family Permit wouldn't be a possibility?
My concern is that because I will have been very recently in the UK and my proof of relationship evidence is almost entirely UK based that this would potentially cause issues.
