Could previous divorce impact Spouse Visa Application?

Post by mhkl310 » Fri Jul 13, 2018 6:25 pm

Hello all, hoping to get some guidance.

Fiance and I have been together 2 years. I am a US citizen, he is a UK citizen.

He is in the final stages of his divorce, which was filed based on the criteria for 2 year separation. The projected finalisation date is around October. We are discussing getting married in January.

In all other ways, we feel we meet the requirements for an approved spouse visa (financial, evidence of relationship, etc). However, I was divorced twice and his divorce would be final 2-3 months before the remarriage would take place.

Could this short period, or the previous divorces, have any impact on whether our visa would be approved - or could it be delayed - assuming we meet all the written requirements?

Shouldn't have any impact, if you're legally divorced and then married and can show evidence of a genuine relationship

Has he sponsored anyone from abroad in his previous marriage?
My comments do not constitute immigration advice, if in doubt consult an immigration adviser/solicitor

His first wife was from India - as are his parents. He was born in England. It was an arranged marriage, and they were married for 19 years and had 4 children (so it was clearly a genuine and long-term marriage).

It's evidence of your own genuine relationship you need to submit, not his previous marriage.

Please don't send me PMs asking for immigration advice on posts that are on the open forum. If I haven't responded there, it's because I don't have the answer. I'm a moderator, not a legal professional.

Yes, I realise this. The previous question was about whether he had sponsored someone from another country previously, and while he has - it was a long-term marriage, not something arranged for her to get a visa. They were married a very long time and had children. So hopefully it doesn't look like he's involved in any kind of scam, simply because his first wife also happened to be from another country.

It shouldnt have an impact on future applications. But all previous sponsorships will need to be declared.
