Hi Experts,
Please cast some light for me. I'm currently on Tier 2 Leave to Remain which was switched from Tier 4 last summer. I just got offer a job from an NHS hospital for band 6 pharmacist. Today HR department phoned me and said they may not be able to sponsor my tier 2 as they think I have to go home and apply for it plus the salary they have to pay for me is £30,000. Basically the HR doesn't want to do a lot of work and she said her boss doesn't want to take risk so she said I have to confirm with HO. Funnily enough, when I contacted HO helpline they said for appropriate salary the employer must tell me. So now I get stuck in the middle.
From my research, I understand that I am classified as 'New Entrant' salary because
- I am now 24 under the age of 26
- And if the COS issued to me only for 2 years, which will make my total stay in Tier 2 less than 3 years and 1 month (My current Tier 2 is 1 year and 14 days long)
So my plan is to ask the HR department to issue me a COS for 2 years and after that 2 years I will re-apply as experienced worker for the same employer and I beleive at that time my salary will be above £30,000.
-And I am eligible to apply for my new Tier 2 Leave to Remain within the UK as long as my current visa hasn't expired
-My SOC is 2213, and appropriate salary for band 6 is £26,565. Can somebody confirm this for me?
