My wife (EEA national) and me (non-EEA national)will have been living in the UK for 5 years in Septemebr. She has started employment in October 2013. She had some small breaks in employment during those 5 years due to changing the job /finding new, so this is understandable, however, we have two problems:
1) once she had more than 1,5 month break due to being on holidays and searching for work (not registered with the job centre as a job-seeker), than she has found self-employed job, but it was giving little income (which can be insufficinet for UKBA (??) - btw is there any minimum amount that she needs to bring home for UKBA to accept?
2) for the past 4 months she has been searching for work (again not registered with job centre)
This together amounts to almost 6 months unemployment/job-seeker. We have all the e-mails proving that she has been searching for work actively and attending interviews, also feedbacks from the employers about not being selected.
So out main concern is, whether will it be enough for the UKBA to acknowledge it as "exercising treaty rights" under job-seeker status during those 6 months? Do you think, with all these e-mails we can easily get the permanent residency? And secondly, will her self-employment (it lasted 3 months - after which she was employed) will be acknowledged by UKBA?
If not, maybe it is better to apply for temporary residency again?
And if a family like ours (with 2 children attending schools) and working, paying taxes, will have any right to apply for permanent residency after 10 years of living in the UK later on?
