Spouse visa entry clearance

I am British, husband Pakistani. Spouse visa to remain refused because he overstayed 3 months in past (his solicitor gave him wrong advise and filed wrong application), we decided to go for entry clearance settlement visa rather than going for judicial review.
He booked his return ticket on 23rd of Aug to go back voluntarily and he is in contact with voluntary department. But now we are thinking if he can stay another month, it'll be very helpful to me as my last payslip is on 21st of Sep for financial requirement and if he can stay another month he can get all the paperwork ready before going back and we can apply entry clearance straight away when he lands in Lahore. But if he leaves in Aug I have to deal with all the paperwork and I am not good at this sort of stuff and we don't want to go to solicitor, past bad experience.
He is confident that voluntary department wouldn't have much of an issue with extending 1 month as long as we provide them the ticket but our concern is would that affect on the outcome of his visa application, would the case worker see this an important factor to judge his character? He never missed any reporting and no convictions and we expecting his overstay wouldn't cause any damage.
Another reason is my brother's wedding is on 1st of Sep and I want him there with me.

Were you applying for FLR(M)? If so when does his current leave expire?

His tier 2 visa was refused for some reason and he wanted to move to spouse visa but solicitor messed up and he overstayed for 2 months, when we finally applied after another month (3 months overstayed) they refused after a year for not considering it a fresh claim. He doesn’t have any leave right now, suppose to leave on 23rd of Aug and last Friday voluntary return called him to check on him if his travel plan remains same, they call every 2 weeks, standard procedure.

If the HO agree to postpone his departure date try and get this in writing/email, it will help with your spouse application.
