Non-EEA family member of an EEA expired family permit

Post by Rakan94 » Tue Jul 24, 2018 3:44 pm

Hi All,

My wife has recently moved to the UK. She's got a family permit (Non-EEA family member of an EEA) valid for six months. I just want know what would happen when her permit expires and what does she need to do before then?

Thank you :)

https://www.gov.uk/family-permit

"Stay after your EEA family permit expires
You can stay in the UK after your permit expires if you:

are the family member of an EEA national - see if you’re eligible
qualify for a ‘Surinder Singh’ application
have a retained right of residence
have a derivative right of residence
You can apply for a residence card card or derivative residence card to confirm your right of residence. You don’t have to apply but it will make it easier to prove your right to live and work in the UK."

Fairly long application form to fill out, EEA FM, normally takes 6 months to process so your partner will be without her passport until it's sorted out. But will get her rights to work (CoA) document within 2 weeks.

Optional 5-year valid card that will cost £65.

Husband's timeline - overstayer 11 yrs
08/16 - FLR (FP) Partner, refused 02/18, 03/18 - JR permission refused with merit
08/18 - FLR FP (Partner) PSC - Approved
07/20 - FLR FP to FLR M Switch - Approved, 03/23 FLR M Ext Approved.

Thank you very much :)

Another question; what would be the case for re-entering the UK after her family permit expires? and can she travel alone or we always need to travel together?

Thanks again,
Rakan
