Can I apply for ILR

Post by Winner2012 » Wed Jul 25, 2018 7:57 am

I got married to a British Citizen(BC) in June 2011,we had 2 kids ,the first in 2012,and the last one in 2014,
The Home Office(HO) issued me with my 2 years in 2012 which finished in 2014,I applied for ILR using the wrong form,I gor another 2 years .
In 2015,my partner refused to sign so I used the 5 year Parent route ,which the HO denied but gave me discretionary leave for 21/2 years which elapses soon.
We are now divorced and I have lived in the country since Oct ,2009 legally.
I have a court ordered contact order and I see the kids regularly.
Please can I now apply for ILR or which form can I used to apply?

If you never break and always have VISA to stay in the UK, the soonest should be based on 10 years residence on OCT 2019 using SET (LR).

10 years LR will be reached in 2022....not 2019. However, what date did you enter the UK ? Was your spouse visa issued in the UK?

FLR(HRO) to extend.

I got into the UK on a student visa Oct ,2009,my Spouse visa was issued in the U.K. in November,2011 which was till 2013
I used the wrong form and thought I was applying for ILR and was issued another 2 years which elapsed in 2015.I applied again and was issued a DL in 2015 which will expire next month.

In combining your time on a Tier 4 visa, the advise above is correct.
