I am getting mixed advice with regards to my wife's visa extension to obtain a 5-year spouse visa.
The conflicting advice I am getting is showing my income going forward.
I was a director of a number of companies and had other sources of income over the past 3 years and have always been paid on a consultancy bases rather than via dividends or salary mainly due to not being a full-time director for any of the companies so was advised by the accountant that I could invoice for my fee as a self-employed contractor. The challenge I face is that due to resigning as a director of that company and no longer receiving a consultancy fee from that company I need to show proof of ongoing income. Even thou this is perfectly fine being a director and not getting paid in the form of dividends or a salary due to having other roles with other companies; apparently, the home office doesn't class that as a source of income even thou it's perfectly fine by HMRC?
I set up a new company that currently has one other director as well as myself; we are both shareholders. Due to this company only being 6 months old I can't show a full year of trading and company tax return. However, the income I have drawn as a now an employee of my own company is quad triple the required proof on income. However due to the company only being 6 months old apparently this income cannot be relied upon?
Lastly, as if it wasn't complicated enough I have had a recent property sale where my share of the income of which I was on the title of the property was 50k. I have deposited 35k into a savings account and utilised the rest of the funds. Can the 35k be utilised to assist in my income? I was advised that it is supposed to be savings held for 6 months however if it comes from a sale of a property that can be considered.
We tick all the boxes for the visa to be approved it just seems that because of the change of circumstances of resigning from the first company and starting my own company has messed things up slightly even thou I am in a far better financial position.
Any assistance on this matter would be greatly appreciated.
