Urgent advise required please

Post by hereb » Thu Jul 26, 2018 11:23 pm

Hi,

I am in UK on tier 4 visa and my hubby and children switched in the country as dependents and the we all have received new brp cards. Before this, my hubby was on Tier 2 ICT visa. After switchover hubby started looking for job change and resigned from old employer thru whom he had come to UK. Today we received a letter from home office stating that tier 2 visa sponsored by ex-employer has been curtailed.

I am wondering if this is an issue as they all have switched over to tier 4 dependents few months back and we all have valid leave to remain for another 3 years. Reason for curtailment mentioned in the letter is that hubby's employment ceased with ex-employer who had sponsored his tier 2 visa under 323A(a)(i)(2). Is this a worrying factor for us? There is no mention of current visa on the letter though.

No. His Tier 2 leave was superseded by the PBS Dependant leave anyway. It is a pointless curtailment.
I do not give immigration advice. I refer you to Immigration Rules, guidance, other online content and to your sponsor.

I would recommend that you write back to the HO with confirmation that he’s now on a Tier 4 dependent’s visa. They maybe holding the wrong information, best to get this sorted before they start incorrect proceedings. Send it by registered post and keep proof of postage.
My comments do not constitute immigration advice, if in doubt consult an immigration adviser/solicitor

Thank you sah10406 and equitydealer for the response. We sent across a letter to HO today through the solicitor.
