ILR For Tier 2 dependant

Hi All,
My husband got Tier 2 dependant visa in October 2013 and then he got extension in June 2016.
Because of job purpose he lived abroad but he did visit me every year for two months.I have got ILR and now I want my husband to get ILR. He is completing his 5 year period on Tier 2 dependant In October 2018. My questions is can he apply for ILR? I know there is a new rule came in Jan 2018 for continuous residency for dependant as well but would he be ok because he got his extension before Jan 2018. Any help would be appreciated.
