ILR via tier 2 Unpaid leave break the continuous period to qualify for ILR?

Post by JP145 » Sat Jul 28, 2018 5:36 pm

Dear All,

tier 2 issues on 13Sep2013 and will apply for ILR on 20Aug2018. I have total 40 day out of country during this period so there is no worry of 180day period on any occasion. however, i was out of country for 30day whole (18 working day) on one single occasion to attend family wedding and this period include 11Days of pre-authorised unpaid leave. Leave was approved by employer and i have Hr leaver with this approval. As i started my tier 2 almost in last quarter of year i did not have enough annual leave to cover the trip in Dec. so i had to take some days unpaid leave.

can you please confirm whether this unpaid leave will break my continuous residence if i apply in Aug2018? Is there anyone who has real life experience where ILR was approved with unpaid leave?

Thank you for your help.

There are no issues with unpaid leave .. Your unpaid leaves are less than 4 weeks.

Just get these leaves as part of your employer absence letter. u shud be fine.

And I am also having few days of unpaid leaves and i am going for ILR few days before ur's... will keep you posted

@JP145 what happened with your ILR? I had 32(15+17)days unpaid holidays (23 working days) in 2016. Can you please post your experience.
