Urgent - VISA expiring in 2 days, IHS problem while completing application

Post by GondalUK » Sun Jul 29, 2018 11:17 am

Respected members,

I need some urgent advice regarding the problem I am getting. Following is my situation:

1- I applied my VISA as Tier 2 (General) on 20th July 2018 with priority and awaiting decision.

2- Now, I tried applying my 4 dependents VISA yesterday, I filled all details and when I filled details for IHS, it asked for main immigrant VISA expiry (which is 31st July 2018 and new VISA is not yet approved). This caused the IHS charges to be 0 for all 4 dependents and now even not allowing me to change. The next step is to pay for application fee.

I am sure that this is some bug, and if I continue with my dependents VISA application with 0 IHS paid, application might get refused.

Can anybody please advice how I should proceed? My VISA was curtailed to 31st July 2018, so I want to apply my dependents VISA before 31st JULY 2018 (although they didn't recieved curtailment letter and thier orginal VISA expiry date is 14th September 2018).

Thanks

a 0 IHS charge does not mean rejection. When I applied for my wifes visa as a dependent I had less than 6 months left on my current visa. So her visa would also have been less than 6 months. She also got 0 IHS charge and got her visa.

As long as you have the reference number that the form gives you and you use that you should be good. My understanding is that visas less than 6 months do not have IHS charge on them.

Also I have seen cases that if everything else is OK and only IHS charges are left then visa is not refused but UKVI sends you a letter directing you to pay IHS.

This is my experience, but wait for another opinion from any experienced member on this as well

If your dependants have not received notice of their curtailments, then their leave have not yet been curtailed. If they are applying for leave, then their leave can not exceed yours. If your current leave has been curtailed to 31st July, then the leave they are currently applying for won’t exceed 31st July. Therefore, by applying now, before there is a decision on your application, they may be worst off.

Hi Vinny and farazk86, Thanks for your reply, it was very helpful.

I think that we shouldn't proceed for dependents application and must wait for the outcome of my Tier 2 VISA application first. I hope I will have decision by end of next week and then we can proceed.

My dependents did not received curtailment letter, so they should be safe for next 6 weeks (until 14th September 2018 which is their current leave expiry).

Thanks

Hi Vinny and other Respected Members,

The situation has become complicated further. Today my employer received an enquiry from UKVI regarding RLMT and there is high likely hood that now my decision will be delayed than postal priority 10 working days.

Also in worst case, my VISA application might get refused if they are not satisfied by response from my employer. According to Vinny, if my dependents have not received a notice of curtailment, than their leave have not yet been curtailed. Will still be applied if my VISA is refused for some reason (if I don't have any valid leave than my dependents leave is connected to my leave)? Will this cause my dependents status as overstayers after if my VISA get refused?

Shall I proceed to my dpendent applications with 0 IHS paid? (this way they might not be become overstayer in the case of my VISA refusal?)

Anybody got any suggestion? Please let me know.

I have now applied VISA for my dependents using standard postal. I thought to share the status until now.

Regarding 0 IHS, after calling UKVI and following their advice I have entered the end date mentioned in my COS (previously I was entering my current VISA expiry). This adjustment fixed 0 IHS problem.

Regarding Curtailment, I was convinced that if there is no notice of curtailment than VISA is not curtailed. But to avoid a risk of becoming overstayers, I have taken another risk and sent Tier 2 Dependents application for my dependents today (on last day of my curtailment).

I got mixed responses on this forum; some people said that if curtailment letter for dependents is not received than VISA is not curtailed and some said that dependents VISA is also curtailed when main immigrant VISA is curtailed. I also tried calling UKVI and they confirmed the case that dependents VISA is curtailed at the time when main immigrant VISA is curtailed and no separate notice of curtailment is sent to dependents.
