I am EEA citizen living in the UK since 2013.
I already have a registration certificate (EEA-QP) issued last year.
I now want to apply for Permanent Residence but I have some doubts about disclosing driving offences.
Sorry for the long post but I want provide enough context.
In December 2016, I was stopped by the police while driving my vehicle with a Portuguese license plate.
The police checked all the documents, took my details and send me away. At this point I had a Portuguese driving license.
In January 2017, I received a letter from the Metropolitan Police with a Conditional Offer of Fixed Penalty for using a vehicle without a valid road test certificate (MOT), which I paid straight away.
6 Months later, I got a letter from the Magistrates' Court to Plead by Post. This is for keeping an unlicensed vehicle. The vehicle was licensed with a Portuguese license, but as I am a resident in the UK, I should have changed the license to a UK one.
I plead guilty by post, never went to the court and paid a fine plus back duty.
The vehicle is now legally in the UK and I have swapped my Portuguese drivers license by UK drivers license.
In the application form for Permanent Residence, they ask if I ever had a A penalty for a driving offence, for example disqualification for speeding or no motor insurance.
To be sure of what I should disclose, I asked ACRO for my records, which are empty. I also asked my records from Disclosure & Barring Service, which are also clear. In my UK driving license, I have no points or endorsements.
To be honest I should disclose that I kept a vehicle with a foreign license plate while being a resident in the UK.
At this point, I am not sure what to disclose or if I should disclose.
What shoul I do?
