Seeking Advice Swedish Visa for Non EU Family member

Hi there,

I am British Citizen and living / working in Karachi Pakistan for last 7 years as an Architect. I am planning to go to Sweden for more than three months beginning of next year. I have bought the house in Sweden as second home for my family. I want to apply visa for my wife for more than 3 months period so she can come to Sweden with me and my son who is also British. I need the information how to apply for the visa more than 3 months and her residence card and How long it will take time for the process?

I want to give you a little background so you have clear picture. I have applied tourist / short term visit visa for my wife in May, 2018 who is non EU Citizen. Our plan was to spent summer holidays for 15 days in Sweden, Norway and Finland with family in mid of June. And the property which I have bought need some modernisation so me and my wife both could take decisions on what sort of building work need to be done and we could select new Spam and bathroom accessories etc etc for this new house.

So when we come back to Sweden next year all major work should be finished. But unfortunately her visa has been refused. And that decision was based on this following reasons.

“Justification for the purpose and conditions of the intended stay was not provided.

Your intention to leave the territory of the Member States before the expiry of the visa could not be ascertained.”

We have appealed but migration court dismiss that appeal on 14th of July, 2018. Migration court does not review the visa requirements for a new period. The migration court writes of the goal.

I was surprised when I heard the Swedish Embassy decision. The free movement is my right as EU Citizen and same for my family under section 2 para. 4 sentence 2 Freedom of Movement Act/EU.


I am seeking advice from you and what further steps to take.
