Need advice on returning to UK; info conflicted

Post by MyWife_MyLife » Thu Aug 02, 2018 3:43 pm

Hi, I voluntarily departed UK 2 weeks ago and I'm back in Australia. I lived in the UK for 4 years and I arrived in 2014 on a T5 youth mobility visa and got married to my british wife in that time then tried to apply through human right to family life as we're a disabled couple and couldn't meet financial requirement. That went on for 2 more years and only resulted in loss of money and failure.. I've been told that reapplying to return at this point even with the financial requirement would result in instant refusal and an appeal would take over a year and more (from a solicitor).

If I got a hold of the requirement in savings (i'm aware of what I need) it would be the requirement, I did voluntarily depart the UK and received no travel ban. So that info about instant refusal and waiting so long for a court appeal conflicts with having heard that if I left voluntarily, I would have no or little issue obtaining the spouse visa as long as the requirements were met.

Also, would I be able to visit the UK for a month in say 6 months time just to make sure everything back 'home' is ok since I wasn't issued with a ban?

Thank you,

Thank you,
If you meet the requirements of the visa, you will be fine because you left voluntarily.

If you want to visit, I would suggest applying for a visit visa in advance to ensure you will be granted entrance, instead of just flying and gambling with the ECO at the airport.
