Wife EU but I am the provider

Post by Kanedafs » Tue Aug 07, 2018 8:43 pm

I don't know my status here in London and how to change it. NIN is refusing my application saying "I don't require a NIN this time", instead of saying "you don't have permission to work".

No one is answering me why. I am bouncing between job centre and 0800. Both says "we don't know why it was denied, ask the other".

On my second NIN appointment, the officer was discriminating and rude with me saying "why don't go Italy? We don't want you here, after Brexit even your wife will not be welcome here anymore".

We are Brazilians. We want to stay here forever. My wife went to Italy to get her Italian citizenship and now she is living for 5 months here in London with her Mother. Her mother is also Brazilian and she is married with a British Citizen. Her mother is living in London for 5 years.

As soon we don't have any coasts here (free room, free meals, etc) I joined my wife without applying from any Visa (4 weeks ago). On the airport I received a stamp on my passport "admitted to UK under EEA regulations 2016" with no expire date. Is this the EEA family permit?

What I need to do from now on?

My wife is not working due to language difficult and no work experiences. I am the home provider, with all the job history, english ielts, recommendation letters and university degrees.

In order for her family to reside in the UK, your EEA citizen spouse needs to exercise treaty rights in the UK. If she is unable to work, she can still exercise treaty rights by being self-sufficient with CSI (aka private health insurance).

She should get private health insurance for herself, you and any other dependent family members and then apply for a Residence Certificate for herself and a Residence Card for you. The latter can be used as proof of your right to work in the UK.

Thanks for the guidance Simon!

Do we need a Solicitor to do this?

Is there any minimum time requirement between her private health insurance signature and the apply for residence card?

How long you think it takes all this? (uintil i can work.. i mean, i am considerating go back to brazil if it takes too long... each day waiting here is a losing money day with no earnings)
