I first came to UK on 22nd Dec 2013 and due to personal emergency i had to go back to India on 29th Oct 2014 for a period of 10 months and then i again came back to UK on 12th Aug 2015. Since there is a gap of 10 months which is more than 180 days continuous absence, i can not apply for ILR in 2018.
But if i apply for ILR in Mar 2019, i may be eligible by back tracking from Mar 2019 to Mar 2014 and counting absences in every 12 months period, which is then splitting my continuous 10 month absence in 2 years.
Number of Absences
Year 5 15 March 2019 14 March 2018 6
Year 4 15 March 2018 14 March 2017 32
Year 3 15 March 2017 14 March 2016 69
Year 2 15 March 2016 14 March 2015 168 Splitting continuous absence in 2 years
Year 1 15 March 2015 14 March 2014 138
