Work permit and Employment Tribunal case

Post by itsmeawan » Sun Aug 12, 2018 11:49 pm

Dear All

I have a situation here. I have been on Tier 2 General since March 2013 with an extension in January 2016-Jan 2019. I completed 5 years on Tier 2 March 2018 but I was dismissed in July 2017. My sponsor did not cancelled my CoS and I still got a valid BRP till 27th January 2019.

I challenged the dismissal, ACAS got involved and I asked for reinstatement as part of settlement which didn't happen and the case went all the way to the employment tribunal and decision made on 12th April by the court in my favour. By that time I already had completed 5 years(March 2018). My employer sent an informal request to the court to reconsider the decision and I was asked to make some comments on the reconsideration.

I have now got another Tier 2 sponsor who have successfully completed the RLMT and selected me for a role through interview and they are in process to assign me a CoS.

My question now is that:
1. what are the chances to successfully change employer when my visa is still valid.
2. What documents do I have to provide when I apply for visa. Because I cant provide 3 months payslips and bank statements.
3. Do I need to tell the HO (when making application) about my dismissal and employment tribunal.
4. If I get the visa with new sponsor, can I apply for ILR after getting one month payslip from new employer and a letter stating they need me for foreseeable future.

Furthermore, if anyone can provide me further information in this regard, I will really appreciate that.

Thanks in advance

Post split from a 10 year old thread and moved to the Tier 2 forum.
