Restricted or Unrestricted COS

Post by OloriA » Mon Aug 13, 2018 11:52 am

Hello there. I'm currently in the UK with a tier 4 student visa and my partner is on a dependant visa as such. However, he got a job and he'd require a tier 2 visa. Does the employer apply for a restricted or an unrestricted COS for his visa application?

Also, because he's been in the country for about 3 years, does he still need to obtain a police clearance from our home country or he only requires the UK DBS for the visa application?

You quick response will be highly appreciated.

Thank you!!!

It would be a restricted CoS.

The criminal record check is mandatory only for certain SoC codes. If your partner's SoC falls in that, he would need a certificate from every country he has lived in (for more than a year) for the last 10 years

Huge thanks for your quick response rubyracer2.

My husband is a medical doctor and we are aware of the recent lift on COS cap for doctors and nurses. We've also read on the UKVI website that dependant partners of Tier 4 visa holders would require a restricted COS. This makes it unclear to us if he still requires a restricted COS or the unrestricted version.

Kindly clarify please.

Thank you.
