litigation debt as grounds for refusal

Hi,

Is there a way of checking to see if there are outstanding litigation debts before submitting an application for leave to remain?

Each year, the Home Office is awarded considerable litigation costs by the courts and tribunal. Some applicants fail to pay these costs. They may then make further applications to be granted entry clearance, leave to enter or leave to remain.

Prior to 6 April 2016, the Immigration Rules did not provide a specific power to refuse such applications on the basis that the applicant owed a litigation debt to the Home Office. This position has now been changed by Statement of Changes in Immigration Rules HC877.

There are contact numbers in the guidance note. Email the legal team following any JR refusal and ask to get an invoice raised. A litigation debt will be there if there is an outstanding debt, so whatever has been sent pay it ASAP.

Husband's timeline - overstayer 11 yrs
08/16 - FLR (FP) Partner, refused 02/18, 03/18 - JR permission refused with merit
08/18 - FLR FP (Partner) PSC - Approved
07/20 - FLR FP to FLR M Switch - Approved, 03/23 FLR M Ext Approved.
