Traveling to a Schengen country with UK EEA Family Member permit

Post by soloadeka » Mon Aug 13, 2018 4:27 pm

Hi,

I hope you can help us.

I'm an EEA national (Polish) and my spouse is a non EEA national (Cuban). I have been residing in the UK permanently since 2005 and I exercise my Treaty rights, so I'm a qualified UK Permanent Residence with a PR card.

We applied for my husband's EEA Family Permit in Havana this morning (fingers crossed), and we are planning to go to Poland at the end of September to visit my family.

Can you please advise if my husband will be able to travel from the UK to Poland on his EEA Family Permit issued for the UK, considering that we intend to travel from the UK (a non Schengen country) to a Schengen country (Poland)?

We've been reading so much recently about the various laws and EU regulations, that there are moments when we doubt what we know, so we're seeking advise here.

Any help and advise on documents we will need to present at the airport, or if there is any additional registration we need to do prior to travelling would be appreciated.

I will mention that by the time of traveling to Poland, my husband will be with me in the UK only for a couple of weeks, so we won't have his Residence Card then yet.

Many thanks

According to the official website of the Polish embassy in London: https://london.mfa.gov.pl/en/consular_i ... y_members/
You do not need an entry visa to enter Poland if you meet all three following requirements:

You are a family member of the EU/EEA citizen
You are travelling together with the EU/EEA citizen to Poland or joining the EU/EEA citizen in Poland (whose family member you are, as defined above)
You are a holder of UK Residence Card of a Family Member of an EEA National

Please, make sure you hold the original of the document proving the family ties with the EU/EEA citizen (e.g. marriage or birth certificate) when crossing the Polish border.
Now, note they say Residence Card, not Family Permit. I would contact the embassy in London to verify.
My posts express what I believe are the facts, based on the best of my knowledge, about the topics discussed in this forum. They do not constitute immigration advice.
