Very Urgent. Employer threatening after ILR

Very Urgent. Employer threatening after ILR

Dear Immigration Board Moderators/Mentors,

After getting my ILR, I have informed my Employer about my resignation via verbally that I'm leaving the company immediately. Initially, employer agreed to accept and the resignation through WhatsApp messages(I have proof) and adviced me to send the resignation dated immediate effect. I also sent the formal resignation. Now he is threatening me to serve notice period.

Below is the Email. Please kindly help me what to do? Thanks in advance.

E-mail Subject: Serious breach of Employment Contract
E-mail: It seems you have no more intention to return to work in company. As you were placed on a client site, so company has faced financial & goodwill losses because of you. Company is planning to take your case as of an absconding employee and can take legal help to recover company losses from you.

Company, Abc Limited, may also try to contact home office and inform them about your absconding scenario and of getting your Indefinite Leave to Remain by deception, for which company is seeking legal advise from company's solicitor.

Company is again instructing you to report at company's headquarter "Address on 17 Aug Friday". Failing to which company may take legal action against you.

Why don't you want to serve your notice period?

Because my employer is unfair and threatening for money. He already charged me some cash for Employer letter which was illegal. I don't know what to do in that situation, so I agree to pay. He is keep on threatening me for money. Else, telling to serve notice period. Please advice what is the solution?

the first thing is you just ask yourself that if your employment is genuine, if so, nothing to worry about. Your employer's behaviour is sufficient to attract trouble to themselves. Do you have proof that your employer dodging you money for employer's letter?

You have full right to work with the others with no restriction after ILR. You are not the slave of your employer and they cannot bound you. Your ILR may revoke only if your employment is actually fake, if so, your employer will also get caught with criminal offence.

Why don't you want to serve your notice period?
Also, if your contract requires you to serve the notice period anyway? If so, and you don't, you need to pay your employer based on the contract.
