Dear experts,

Hope you all are well. I am in the UK since 2009 i am on tier 4 visa that end in November 2018. My stay here including tier 4 visas and PSW. I have left 13 months in the eight years cap. I have applied to a university for admission and the course starting on the 8th September 2018. They have checked my all visas, documents, personal statements and financial documents. They checked my immigration history from the UKVI on my written consent. I have a clear history.They have informed me that they checked your history and you have passed the immigration check. Now they are issuing me with a CAS letter and also submitting my visa application as i am satisfying all the ppints as they have my all documents and bank statement. they are also satisfied. It is a good ranking university. Would there be any issue with my visa application after submission now? Thanks

I am assuming that either some of your previous studies was below degree level, or you are applying for a PhD, as otherwise you would be subject to the 5-year cap.

There will probably be a very close scrutiny of your credibility, as there may be a suspicion that you are applying in order to complete 10 years in the UK and apply for ILR. Your Tier 4 sponsor has presumably considered this and advised you on it.

Thanks for your reply! Actually my main aim is to get a PhD. I can get admission in PhD but in that case I will pass the eight years limit. There is no course below the degree level. My previous course took longer than normal time due to my severe illness and I am still on medication. The course I have applied for is level 11 and the new university had asked me to write a statement to UKVI that why I am pursuing this degree. I wrote that and they accepted, so it shows academic progression. Only in ILR case I can secure phd. I am happy to go for an interview if they ask as I already satisfied the university with my points. Just wondering if the university checked my every thing and calculated my time , and if I pay the tuition fee and in the middle of the course and then there is visa issue , that would be bad. Thanks

So you have already completed a PhD or postgraduate research qualification? That would be the only reason the 8-year cap would apply.

Thanks. I have not completed PhD but completed a post graduate research degree. I still have more than a year left in eight years limit. The new University has calculated my time and immigration check and they are satisfied. Based on all checks they are giving me CAS letter. They had asked if your intention of doing this course to get to PhD then we wouldn't give you admission cuz in this case you would pass the eight years cap. Now if I apply for visa in the next few days and the whole process roghly takes 8-10 weeks and by that time I would have been finished my first semester. This current university has checked every single document, Visas and time. God knows but I think I should be ok with the application! Thanks
