French Residency Card moving to Ireland

Post by Roxanaslovazch » Sun Aug 19, 2018 9:54 am

Hi all Iam a Romanian citizen working full time in France and my husband is a non eu citizen originally from Morocco , we are married in France since August 2017 , we like to move to Ireland so I can finish my degree however my husband has French residency of spouse of eu family we will be traveling to Ireland soon , we have visited the French embassy regarding his visa and they said he will not need a visa to enter because I will be excersing my freedom of movements and we need to carry our marriage documents from France and his French residency but he will need to apply for residence in Republic of Ireland after three months. Has anyone been through this precudure before and is he allowed to work with his French residency in Ireland ?
Thanks in advance

That’s correct, he can enter Ireland without a visa if travelling with you and carrying his French residence card and marriage documents.

He won’t be allowed to work in Ireland though, he will need to apply for EU Treaty Rights in Ireland in order to be able to reside and work.

See the link explaining the process you will need to follow below:

Thanks for the reply max307 , we are currently both working full time and my main concern is we are moving to the Republic of Ireland because I would like to finish my degree so my husband will be working full time while Iam studying.we currently have our savings to be secure in the time we are settling.
do you have any idea How much available funds balance we need to provide with the residence card application to prove we won’t be needing any type of financial support from the state ?
Do we need to make the 4 eu card application with a solicitor?
And he has already been granted 5 years residency in France because he is my husband under eu treaty rights , would this make the process quicker to grant his residency in the Republic of Ireland because our relationship has already been established by another eu country? We can provide bills that we have been living together , tenancy agreements , pictures ,joint bank accounts , marriage certificates etc
Is there any chance he would be able to work or study while the application is being processed ?
Because he likes living in France and he can speak better French then English but his willing to move for us and My career so I kind of feel guilty if he will be waiting at home for 6months
Thanks in advance

I don’t think there is a minimum you will need to present but obviously the more savings you have the better. I would recommend to transfer your savings to an Irish bank account as soon as you arrive to make it hassle free for INIS.

Do we need to make the 4 eu card application with a solicitor?

Not necessarily, it is a straight forward application and if you follow the link I have provided you shouldn't have any issues.

And he has already been granted 5 years residency in France because he is my husband under eu treaty rights, would this make the process quicker to grant his residency in the Republic of Ireland because our relationship has already been established by another eu country?

No. Expect long delays as they are currently dealing with a backlog of applications.

We can provide bills that we have been living together , tenancy agreements , pictures ,joint bank accounts , marriage certificates etc. Is there any chance he would be able to work or study while the application is being processed ?

Just one quick note - your bills, tenancy agreements, etc. must be in Ireland and you have 90 days from initial entry to lodge your application. He won't be allowed to work or study while the application is processing, in the best case scenario they will issue a temporary Stamp 4 after the initial review of the application (8 weeks average) and with that Stamp 4 he can work or study while the final application is approved. I just want to add that the temporary Stamp 4 isn’t guaranteed and he could be waiting for 6 months or more and unable to work or study.
