Fiance Colombian Living in Spain me in the UK Help!

Post by Plati » Mon Aug 20, 2018 2:29 pm

Hi

So my Colombian fiance and myself (from the UK) have been "together" for just over 18months. We met online gaming January 2017 but via Discord and other ways to chat we established a relationship albeit online on the 22nd Feb 2017. I then travelled to Spain in the July that followed along with my youngest son who is now 3 years old. We stayed together in an apartment for a full week. Since then I have also gone back 2 more times to visit him and are planning to spend Christmas 2018 together along with my 3 other children. He has lived in Spain since he was 17 however recently lost his job due to his workshop being closed as his boss has long term illness.

On my last visit a few weeks ago we got engaged and am now trying to gather as much information as possible to enable our relationship to progress. I see there are several ways I currently (however) dont earn £18,600 being a single parent and living in Cornwall with pretty naff wages.

My question is which is the best way around this?
Marry in Spain and apply there?
Marry and live there and if so how long for?
Marry in the Uk and apply for the 6months looking to extend? And If so does this require me to earn said £18k?

My eldest son is 18 and will be going on my Housing tenancy (its a housing association house so secure for 99 years) so once my other sons (within 3 years) have finished their education living in Spain could be viable however not right now (unless I do so in the Summer holidays etc as I work in education)

Sorry its a bit of a ramble but any advice would be brilliant

Thanks Jo x

Marry in Spain and apply there? The £18,600 p.a minimum income level is mandatory for a Spouse Settlement visa.
Marry and live there and if so how long for? In order to follow the Surinder Singh route you would have to move 'the centre of your life' to Spain which would include rental or purchase of property, employment or study and local integration. Probably 6 months would be the minimum, but the longer the period of residence the more chance of success. However, be aware that with Brexit on the horizon, this route is likely to close.
Marry in the Uk and apply for the 6months looking to extend? And If so does this require me to earn said £18k? The same requirement for earnings of £18,600 p.a or £62,500 in savings.
