Tier 1 (Graduate Entrepreneur) visa

Post by saleemkhan1 » Wed Aug 22, 2018 8:04 pm

Hi experts,

I have recently finished my MPhil course. I am currently on Tier 4 student visa. I had applied from overseas and obtained my current visa which will get expired in November 2018. I have had post study work permit back in 2012-14. Now I want to apply to Tier 1 (Graduate Entrepreneur) visa. Can I apply to this visa. Please find below the detail. I am just wondering am I eligible to apply to this visa despite of having had PSW in the past.

Thanks
Regards,
Saleem

Eligibility
The eligibility requirements for this visa depend on who is endorsing you.

Endorsement by a UK higher education institution (HEI)
You need all of the following to be eligible:

a UK-recognised bachelor’s degree, master’s degree or PhD awarded before your date of endorsement
endorsement from an authorised UK higher education institution issued in the past 3 months
£945 in savings if applying from inside the UK, or £1,890 if applying from outside the UK - this is to prove you can support yourself and you must have had this in your bank account for 90 days before you apply
to meet the English language requirement
permission to remain in the UK from your financial sponsor if they’re a government or an international scholarship agency and have paid your course fees and living costs in the past 12 months.

I do not see how PSW is related to this.
Please read the Tier 1GE guide: https://www.gov.uk/government/publicati ... trepreneur

Thanks. I am just confused about the below statements. If you could clarify this, I would be grateful.

You must meet all of the Tier 1 (Graduate Entrepreneur) visa’s eligibility requirements.

You can’t switch to this visa if you’ve already had a visa under one of the following categories:

Tier 1 (Post Study Worker)
Fresh Talent: Working in Scotland Scheme
International Graduates Scheme
Science and Engineering Graduate Scheme

The link is given below for this!

Ok so I looked this up in the immigration rules and it seems you are not eligible because of the PSW.
Under paragraph 245FB. Requirements for entry clearance or leave to remain it says:
(g) The applicant must not have previously been granted entry clearance, leave to enter or remain as a Tier 1 (Post-Study Work) Migrant, a Participant in the Fresh Talent: Working in Scotland Scheme, or a Participant in the International Graduates Scheme (or its predecessor, the Science and Engineering Graduates Scheme).

That is correct. You can apply for a Tier 1 Entrepreneur visa though or a Tier 1 Exceptional Talent (provided you meet other qualifications)
