FLR FP Extension - No longer a Dependent.

Hello,

If anyone could help me or provide advice I would be truely grateful.

In October 2014 my mother was granted 10 year route to settlement - parent route (flr fp) and I was granted under this category has her dependent child. We renewed for the first time in 2016 and even though at this point I was over 18 I was still granted leave under the category as her dependent(not leading an independent life at the time). However in March 2019 my visa will be due for renewal, but I am no longer a dependent of my mother as I have begun to lead an independent life. I have moved out, I have a 2 year old British son from a previous relationship and I am currently pregnant with my second child due October of this year. She will also be British as my current parent/her dad has ILR.

However, I am confused as to if I can extended my visa under the same category as I have/will have two dependent child of my own and one who I sole responsibility for as his father is not in the picture at all. I was told by a solicitor that I will qualify due to my children and anything previous leave will brought over also but he then told me when I asked if I could use the premium service that I could not because this application can only be done by post ? :s

Lastly, my partner claims child benefit which is in his name alone and child tax credit which is in joint names as I read in the public funds guidance that this is okay ? But I have this nagging feeling that maybe this will effect my renewal ?

Has anyone had a similar situation or can you advice that I am correct in thinking that I can still extend my visa under the FLR FP route as a parent and will not have to go under a different route?

Anyone please ?

Also I received a response from the solicitor I contacted that said premium service is only for flr fp 5 year routes not 10 year is this correct ?

DO NOT apply premium. Your case is not straight-forward (at all) and will not be decided on the day. The premium fee will not be refunded.

You are no longer a dependent and will have to make an application based on other reasons- presumably as the parent with sole responsibility of your 2 year old.

Are you with the father of your current pregnancy?

Fine. Are you in a relationship with the mother of the current pregnancy.

It looks most like you will need to apply for FLR(FP) based on your relationship with your child from the previous relationship.
