Child born to uk citizen, now an adult, in the USA, citizen or not?

Post by Britbobby0123 » Sat Aug 25, 2018 10:19 am

Hello,
First post here, I’ve done some browsing but haven’t found a definitive answer to my particular set of circumstances so here’s my question:

I lived in the US and had a daughter to a US citizen in 1998. She’s now 19.
I am a UK citizen by birth and have been residing in the UK since 2010.
My daughter has a 2 yr old son, born in the US.
She wants to move here with her son.

As I understand it, my daughter is able to apply for a passport as she is a British citizen,(or would be after application is approved), by decent, but she will not be able to pass her citizenship on to her son.
So, does this mean she can simply apply for a passport or does she have to go through the naturalisation process?

Any information and advice is greatly appreciated, thanks in advance if you have time to answer my question.

Were you born in the UK or outside the UK?

Does your daughter have sole responsibility for her child?

Has your daughter ever lived in the UK?

Yes, I was born in the uk to British citizen parents.

My daughter does have sole responsibility for my grandson.

And, my daughter has NEVER lived in the uk.

Thanks!

Were you married to your daughter’s mother at the time of her birth?

I think that your daughter is British by descent.

However, her child isn’t. Child may apply for a settlement visa, subject to sole responsibility, adequate maintenance and accommodation, etc. Child would be entitled to register after residing in the UK for at least 3 years.
