EEA Residence card refused!!!

Post by Shay1202 » Sat Aug 25, 2018 5:23 pm

Hi everyone..

I was hoping someone could please give us advice on what to do next as we think the best step would be to see a solicitor...

My husband is a British citizen and we both lived in Ireland for 7 months (Aug 2016 to Feb 2017), a family member then fell seriously ill and we decided to relocate back to Scotland (where he is from). I am a South African citizen and applied for an EEA family permit to join him, this was approved and we moved back on the 01/03/2017. I have since then applied twice for a residence card which has been refused on both occasions. First, was because we didn't provide the original marriage certificate. The second time was because they felt we did not integrate our center of life in Ireland (even if we provided work documents, registration with the medical offices and rental contracts). We received this refusal on the 24/08/2018, but the letter was dated the 24/07/2018 and they only gave us 14 days to appeal from this date (which has obviously now passed). My passport is now expired and I will need to apply for a new one as well..

I'm totally at a loss and have no idea what to do.. totally distraught.. :(

Maybe a silly question but, did you supply the same evidence for the family permit than for your failed residence card applications?
First, was because we didn't provide the original marriage certificate.
It could be a good idea to see a solicitor.
The second time was because they felt we did not integrate our center of life in Ireland (even if we provided work documents, registration with the medical offices and rental contracts).
Hence why I ask if you changed the evidence submitted. If they granted you the Family Permit, and you have already left Ireland, I cannot see how you could supply even further evidence of your life there. I think whatever you supplied for your Family Permit application should have sufficed. In any case, make sure to check, or have your solicitor check, that you supply all that is requested in section 9 of the guide to supporting documents, page 8 of 19: https://assets.publishing.service.gov.u ... -04_KP.pdf
